1. Yona.ink APPLICATION AND ITS USE

Thank you for installing the application “yona. in” and for your visit to the website https://yona.ink. The usage of the said application is subject to the Terms and Conditions and our Privacy Policy available here on this site.

This document is an electronic record in terms of the Information Technology Act, 2000, and rules thereunder as applicable, as well as the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of www.yona.ink. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Yona.ink hereby grants the user a non-exclusive, non-transferable, limited license to use the website and/or app, subject to the unconditional acceptance of all these terms and conditions (called “Terms” or “Terms and Conditions”) governing use of this website and/or app, and the user hereby agrees to familiarize himself/herself with the terms and conditions and other terms and guidelines found throughout this website and/or app and abide by them. By downloading or otherwise having access to receiving or using the services website in any manner, you hereby agree to have read, understood, and accepted the terms and conditions provided herein. You may access the privacy policy from the application, where it is available alongside the terms and conditions. If you do not agree to be bound by this agreement, please do not download or install, or use the application.

The Yona reserves the right to make any changes to the terms and conditions and/or our privacy policy as we deem necessary or desirable without prior notification to you. We suggest, therefore, that you read our ‘Terms and Conditions’ and ‘Privacy Policy’ from time to time in order to be informed as to such Terms and Conditions. If we make changes to our T&C and Privacy policy, and you continue to use our site, you are implicitly agreeing to the revised T&C and Privacy policy provided by the website https://yona.ink/ . These Terms and the Privacy Policy together constitute a legal agreement (“agreement”) between you and the Yona in connection with your visit to the website and your use of the services provided by Yona.

Yona shall not be responsible or liable, in any way, for any act or omission on the part of any service provider.

The terms and conditions apply to all users of this website and, in case of conflict, will prevail over any other document.

2. YOUR ACCOUNT

If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure, and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner. Yona reserves the right to refuse access to the website, terminate accounts, remove or edit content at any time without notice to you.

In Yona.ink, you can also be a guest user of the site by entering the mandatory fields alone. However, there are some limitations for guest users compared to other users.

Yona.ink, may, by its services, collect information relating to the devices through which you access the site and other data of your usage. The collected information will be used only for improving the quality of Yona services and to build new services.

The site allows Yona to have access to registered users’ personal email or phone number for communication purposes so as to provide you with better service, and for obtaining feedback in relation to the service providers and their practice.

3. USER CRITERIA

Use of the website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including minors, undischarged insolvents, etc., are not eligible to use the website. If you are a minor, i.e., under the age of 18 years, you shall not register as a user of the website and shall not use the website. As a minor, if you wish to use the website, such use may be made by your legal guardian or parents on the website. You represent and warrant that you are not a person barred from receiving the site services under the laws as applicable in India. You also agree to provide true, accurate, current, and complete information about yourself as prompted by the site's registration form. If you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or if we have grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the site (or any portion thereof). If you use the site, you are responsible for maintaining the confidentiality of your account and password, including cases when it is being used by any of your family members, friends, or relatives, whether a minor or an adult. You further agree to accept responsibility for all transactions made from your account and any dispute arising out of any misuse of your account, whether by any family member, friend, relative, any third party, or otherwise, shall not be entertained by the company. Because of this, we strongly recommend that you exit from your account at the end of each session. We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.

At the time of installation of the application on a device or on an existing device, the application will require permission to enable it to find the location of your device, phone/SIM contacts, camera, SMS, and other required device data permissions, etc., to provide service(s). You acknowledge that you agree to provide such permissions, failing which, you may be restricted from using certain services or parts thereof.

The user shall not use the User ID and/or password of any other person for any purpose whatsoever without proper authorization from such person.

4. COMMUNICATION

When you use the website or send emails or other data, information, or communication to us, you agree and understand that you are communicating with us through electronic records and you consent to receive communications via electronic records from us periodically and as and when required. We may communicate with you by email or by another mode of communication, electronic or otherwise.

Further, you agree, understand, and acknowledge that the website is an online platform that enables you to purchase products listed on the website at the price indicated therein at any time from any location. You further agree and acknowledge that Yona is only a facilitator and is not, and cannot be, a party to control in any manner any transactions on the website. Accordingly, the contract of sale of products on the website shall be a strictly bipartite contract between you and the sellers on yona.ink.

5. COMPLIANCE

You agree to comply with all the laws, rules, and practices regarding online conduct and acceptable content. You agree not to violate any laws or regulations for the time being in force outside or inside India. You are wholly responsible for the confidentiality and activities of your password and account. You agree not to use the website or its content or services in any illegal or unauthorized manner. You agree not to use any inside or outside data that injures the reputation and standing of Yona and its users. You agree not to act in any manner that may be detrimental to the website, yona.ink, and its users. You accept that you shall not disclose to any other person in any other manner whatsoever, any confidential information and any intellectual property owned by Yona, obtained in the course of availing the services through the website. You further agree to comply, with you accept and abide by all other operating rules, policies, and procedures that may be published from time to time on the site by Yona.

6. OUR CONTRACT

Your order is an offer to us to buy the product(s) in your order. When you place an order to purchase a product from us, you will receive an email confirming receipt of your order and containing the details of your order (the "Order Confirmation E-mail"). The Order Confirmation email is an acknowledgement that we have received your order, but does not confirm acceptance of your offer to buy the product(s) ordered. We only accept your offer, and conclude the contract of sale for a product ordered by you when the product is dispatched to you and an SMS confirmation is sent to you that the product has been dispatched to you.

Your account and buying facilitation are accomplished by Yona, while every purchase is directly from the trader selling on Yona.ink. You confirm that the product(s) ordered through your account (by you or any other authorized person to access the account), shall be purchased for your own personal purpose and not for resale or business purposes. For Bulk purchases, you may contact our Support desk as well. You authorize us to declare and provide a declaration to any governmental authority on your behalf stating the aforesaid purpose of the products ordered by you on the website. You may cancel your order for a product at no cost any time before we send the dispatch confirmation SMS relating to that product.

7. PRICING AND AVAILABILITY

The prices mentioned on the site are subject to the pricing policy of Yona.ink, and the changes in prices thereof shall be determined only at the sole discretion of Yona. ink Product prices listed on the website are current. While every care has been taken to label the products accurately, errors in data entry and updating may occur. We reserve the right to cancel the order in case a transaction has been made where the price indicated was not the correct price. In the rare event that it happens, we will give a full refund of the money received from the customer. Prices are subject to change without advance notice.

All prices on this website will be in Indian rupees. For international cards used on the site, the banks' applicable exchange rate and charges will apply. We have no jurisdiction on this, and any disputes or queries on exchange rates and bank charges need to be directed to the bank or institution that issued your card or payment instrument.

We list availability information for products sold by us on the website, on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, you will be informed by email if any products you order turn out to be unavailable.

All orders are acknowledged at current pricing. Our endeavor is to ensure that all products listed on the site are available in stock for dispatch to the buyer. However, in case this is not available for any reason, we will contact you within two business days and give you the option to exchange, delay, or cancel the order based on your convenience. In the event that you wish to proceed with your order, the amount shall be debited from your credit card account.

The payment may be processed prior to the dispatch of the product that you have ordered. If Yona.ink has to cancel the order after processing payment, the said amount will be reversed back to your account within a maximum of 7-10 working days. However, no refunds shall be applicable on the orders made by the customer(s) under the Cash on Delivery (“COD”) option.

The price of our merchandise is inclusive of the service tax, Goods and Services Tax ("GST"), duties and cesses as applicable - unless stated otherwise . The tax rate applied to the order will be the combined tax rate for both state and local tax rates in accordance with the address where the order is being shipped. We reserve the right to collect taxes for shipping charges wherever applicable.

Please note that there may be certain orders that we are unable to accept and must be cancelled. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled shall include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, problems identified by our credit and fraud avoidance department, or any defect regarding the quality of the product. In such cases, you will be properly informed of the sam,e and if your credit card has been charged, the said amount will be reversed back to your account.

Yona may also require additional verifications or information before accepting any order. In case of requests for order cancellations, we reserve the right to accept or reject requests for order cancellations for any reason. As part of usual business practice, if we receive a cancellation notice and the order has not been processed/approved by us, we shall cancel the order and refund the entire amount. A request for cancellation of an order shall be valid and accepted only if they are made within 24 (twenty-four) hours of making the order on the site. We will not be able to cancel orders that have already been processed or orders for which request for cancellation is made after the expiry of 24 (twenty-four) hours from making the order. We have the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by us and accepts our decision regarding the cancellation. In the event of cancellation of the order by the customer,r we shall not refund the voucher, if any, used against such order.

8. FRAUDULENT USE

Our fraud detection team constantly monitors the users’ account in order to avoid fraudulent accounts and transactions. Users with more than one account or availing referral vouchers fraudulently shall be liable for legal actions under law, and we reserve the right to recover the cost of goods, collection charges, and lawyers’ fees from persons using the site fraudulently. We reserve the right to initiate legal proceedings against such persons for fraudulent use of the site and any other unlawful acts or omissions in breach of these terms and conditions. In the event of detection of any fraudulent or declined transaction, prior to initiation of legal actions, we reserve the right to immediately delete such account and dishonor all past and pending orders without any liability. For the purpose of this clause, we shall owe no liability for any refunds.

You agree, understand, and confirm that the credit card details provided by you for availing various services on the site will be correct and accurate, and you shall not use the credit card which is not lawfully owned by you, i.e., in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details to the site. The said information will not be utilized and shared by the site to any of the third parties unless required for fraud verifications or by law, regulation or court order. The site will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you.

When you use the site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email, SMS, or by posting notices on the site. You agree that all agreements, notices, disclosures,s and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Access to and use of password protected and/or secure areas of the site is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the site may be subject to prosecution.

Yona may terminate this agreement and passwords or accounts of the user in the event of any conduct by the user which that Yona, in its sole discretion, considers to be unacceptable or in the event of any breach by the user of this agreement. yona.ink shall have the absolute right to remove content, suspend you, suspend or terminate your account, prohibit access to the site and take legal or technical steps to stop you from availing the services of this site if you breach this agreement or if you fail to comply with the guidelines or other policies of this site or has been acting fraudulently or illegally that is causing inconvenience or financial loss to yona.ink or its users.

9. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated or anything to the contrary, all Intellectual Property Rights to and into the website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions, goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks are the sole property of yona.ink.

The trademarks, logos and service marks ("Marks") displayed on the site, all information and content including any software programs available on or through the site and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music, sound, and the entire contents are the property of yona.ink/traders and/or other authorized persons / organizations allied. The user represents and warrants that the intellectual property displayed and part of Yona.ink will not be used in any manner that infringes the rights of Yona.ink, failing of which Yona.ink is within its right to initiate any legal or technical actions against you.

10. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Yona does not warrant the accurateness or completeness of any data or information regarding any products or services. Yona does not warrant continuous and uninterrupted access to the site and operation of the site may be hindered due to factors beyond the control of Yona. In no event shall Yona be liable for user content, user’s transmission or data, third party interference, unavailability of products or services, damage of user’s data or information beyond the control of Yona. In case of any dispute regarding the products or services, the maximum liability will not be more than the cost of such product or services.

11. EVENTS BEYOND OUR REASONABLE CONTROL

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises due to cause which is beyond our reasonable control. This condition does not affect your statutory rights.

12. DELIVERY

yona endeavors but does not guarantee to deliver the products to customers within 1-2 weeks from the day of close of sale depending upon the shipping location. Other factors include delay in delivery through the courier partner, transporters' strike etc. Once the payment transaction has been successfully completed, your order will be processed on receipt of the funds from the bank or credit card company. It is at this stage that the sale is said to be complete. Thereafter, your products will be shipped based on product availability and completion of logistics operations related to the same. Our endeavor is to make the products reach you within 7-8 business days from receipt of payment.

Order deliveries will be made by our own staff or third-party courier and logistics companies usually between 9am – 5pm, on from Monday to Saturday.

Further, we may at times be unable to deliver the confirmed order(s) to you and the reason for the same could be inclusive of but not limited to the following:

(i) Unavailability of the relevant product;

(ii) Poor/improper/defective quality of the relevant product ascertained through our quality audit process; and

(iii) Inaccuracies or errors in product or pricing information.

In the event of any circumstance(s) as aforementioned; you shall not be entitled to any damages, monetary compensation, redeemable vouchers and /or store credits.

In case we are unable to deliver the confirmed order(s) as mentioned hereinabove and the payment for such order(s) has been made by you through your credit/debit card, the amount paid by you while placing the order(s) on the site will be reversed back to your card account.

Goods will need to be signed upon delivery. We take no responsibility for goods signed by an alternative person other than the person ordering the product at the address indicated at the time of the order .

Since the transactions are authorized by the card holder, we do not take responsibility for incorrect addresses provided at the time of placing the order.

12 .1 DELIVERY CHARGES

Shipping and handling rates may vary based on product, packaging, size, volume, type and other considerations. The shipping and handling charges are given at the time of check out and consumers will know about this before making payments.

12 .2 PRODUCT RETURNS

Once products are delivered to you and accepted as accurate and as per the original order, there is no refund or exchange possible.

To return items that are discovered not as per your original order, please contact our Support Desk at support@yona.ink.

All returned items must be accompanied by a copy of the original receipt, a return / exchange authorization number and in unopened, saleable condition. Postage and charges for return of these will not be refunded.

Please note that in any case we cannot offer exchanges or refunds on any sale, opened or used products.

Please allow three to four weeks from the day you return your package for your request to be processed. You will be contacted once your return is complete. All claims for the change of the product must be reported to customer service within 48 hours of product acceptance.

In case of guest users, returns, refunds, and cancellations will be possible only after registering as a normal user. Also, guest users do not enjoy COD.

13. INDEMNITY

yona will take all its efforts to dispatch the product in such a way to ensure that the product reaches the buyer safely. However, because of the nature of the product, if it arrives damaged, yona will not be responsible. In the event of a product being damaged, you may contact our Support Desk, and return shall be arranged. As every product is default insured at the time of purchase, such insurance shall cover the product liability ensuring customer ease. For such claims, traders shall connect with yona Support Desk for assistance.

Yona.ink makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the website, the information contained on the website, you or your company’s personal information or material and information transmitted over our system.

You agree to indemnify and hold yona.ink(and its officers, directors, agents, subsidiaries, affiliates, joint ventures, and employees) harmless from any claim or demand, including but not limited to reasonable attorneys’ fees, or arising out of or related to your breach of this Agreement or your violation of any law or the rights of a third party.

14. POLICY RELATING TO POSTS & COMMENTS ON THE SITE.

a. yona makes no representations as to the accuracy or completeness of any comments on the site or any other site found by following any link on the site.

b. yona reserves the right to block or delete any comments submitted by the user without notice if:

(i) The comments are deemed to be spam or questionable spam.

(ii) The comments are harmful, threatening, abusive, harassing, blasphemous, objectionable, defamatory, vulgar, obscene, pornographic, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever.

c. yona accepts no responsibility for the comments made on the posts and any harm resulting thereof.

d. yona.ink shall not be liable for (a) any errors or omissions in the comments or (b) for the availability of these comments.

e. You are solely responsible for the content that you choose to submit for publication on the site, including any feedback, ratings, or reviews (“Critical Content”). The role of yona in publishing Critical Content is restricted to that of an ‘intermediary’ under the Information Technology Act, 2000. yona disclaims all responsibility with respect to the content of critical content, and its role with respect to such content is restricted to its obligations as an ‘intermediary’ under the said Act. yona shall not be liable to pay any consideration to any user for re-publishing any content across any of its platforms.

f. You hereby agree not to post or publish any content on the website that:

(a) infringes any third-party intellectual property or publicity or privacy rights, or

(b) violates any applicable law or regulation, including but not limited to the Information Technology (Intermediaries Guidelines) Rules, 2011 (“IG Rules”) and Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal or Information Rules,2011(“SPI Rules”). Yona.ink, at its sole discretion, may choose not to publish your reviews and feedback, if so required by applicable law.

You agree that Yona.ink may contact you through telephone, email, SMS, Video, WhatsApp or any other electronic means of communication for the purpose of:

1. Obtaining feedback in relation to site or the services of yona; and/or

2. Obtaining feedback in relation to any service providers listed on the website; and/or

3. Resolving any complaints, information, or queries by service providers regarding your critical content; and you agree to provide your complete cooperation further to such communication by the yona.

15. GENERAL

a. The s ite makes no warranty or representation that any errors in the site will be corrected except as required by Law.

b. The site assumes no responsibility and / or liability with respect to any user content or service provider content (as applicable) which you may post on the website and you are solely responsible for such user content posted on the site .

c. You agree that the open and real-time nature of the site make it impossible for site to vouch for the validity, authenticity and honesty of user content or service provider content. The site is not responsible for any user content or service provider content on the site or for the consequences of you reading or relying on such content.

d. The site is provided on “As Is” and “As Available” basis. Neither the site nor any service provider is liable for any technical or other operational difficulties or problems which may result in loss of your data, personalization settings or other interruptions in the features offered on the site. Neither the site nor any third party is liable for the deletion, loss, miss-delivery, timeliness or failure to store or transmit any user content or service provider content, site content or your personalization settings.

e. The site does not provide any guarantee and shall not be held liable or responsible for the failure to send SMS or other notifications or reminders to you as a feature of the website.

f. Under no circumstances shall yona be liable for any indirect, incidental, special, punitive or consequential damages, any loss of profits/revenue/goodwill or any indirect or remote loss that the user or anyone claiming through the user may suffer.

16. RIGHT OF Yona FOR TERMINATION/ SUSPENSION

yona.ink reserves its right to refuse service, restrict, suspend, terminate the user’s account; terminate this agreement; terminate or suspend the user’s access to the site; move, or remove any content, details that are available on the site; deactivate or delete the user’s account and all related information and files in the user’s account; establish general practices and limits concerning use of this site at any time, in its sole discretion with or without cause, and with or without any prior notice for any violation of the Terms of Usage. Upon such termination or suspension, the user’s right to use the site will immediately cease, the data stored by the user in the user’s account shall cease to be available to the user and Yona.ink shall not be obliged to provide the user with the same for any reason whatsoever.

17. LEGAL RELATIONSHIP BETWEEN Yona & VENDORS

None of the provisions of this agreement, terms and conditions, notices or the right to use the site by the user contained herein or any other section or pages of the site and/or the linked sites, shall be deemed to constitute a partnership between the vendor and yona.ink and no party shall be deemed to be the agent of the other in any way.

18. COMMUNICATION WITH USERS

Yona online reserves the right to communicate with users of the site; the user hereby agrees to receive messages from Yona from time to time. However, under emergency situations, yona.ink might reach out to you irrespective of the user’s registration for ‘Do Not Disturb/Call’ under TRAI regulations. This is to ensure safety and commitment to facilitate customers with a secure account and transparent transactions.

19. FORCE MAJEURE

Yona shall have no liability to the user for any interruption or delay, to access the site, irrespective of the cause. yona.ink shall also not be liable for any failure or delay which is due to any element of nature or Act of God, fire, flood, earthquake, war, explosion, acts of terrorism, governmental action, riots, insurrection, epidemic, quarantine directions issued by the government, breakdown of internet connection, power failure, strikes or labor disputes.

20. GOVERNING LAW AND JURISDICTION

These terms and conditions are governed by and construed in accordance with the laws of India. You agree, as we do, to submit to the exclusive jurisdiction of the courts at Ernakulam, Kerala in respect of any dispute or difference and all matters arising in or in connection with or under these terms and conditions. The failure of the site to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. The site does not guarantee that it will take action against all breaches of this T&C. Except as otherwise, expressly provided in this T&C, there shall be no third-party beneficiaries to this T&C. This T&C constitutes the entire agreement between you and yona.ink and governs your use of the site, superseding any prior agreements between you and yona.ink with respect to the site.

21. REDRESSAL FORUM

In the event you come across any violation by another user including but not limited to having content in the website that is obscene, menacing, grossly offensive, harming minors, infringing copyright, patents, etc., or if another user is impersonating etc. you may then please be free to provide your concerns in writing or email us with digital signature to:

Redressal Forum: EC Store Support Desk Redressal Committee

The Redressal Forum shall be available between 10 am till 6 pm Indian Standard Time from Monday to Friday, except applicable holidays declared by the law of the land (India). The Redressal Forum is appointed as per Rule 3 (11) of The Information Technology (Intermediaries Guidelines) Rules, 2011. Any and all complaints to the Redressal Forum shall be in writing.

The Redressal Forum shall handle complaints in relation to the following violation by the user of computer resource as the user is not entitled to host, display, upload, modify, publish, transmit, update or share any information on the website/app that -

1. belongs to another person and to which the user does not have any right to;

2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophiliac, libelous , invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;

4. infringes any patent, trademark, copyright or other proprietary rights;

6. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

8. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

9. threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

The user shall be required to provide the following information in the complaint :

A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner for the purposes of the complaint, ( in which case a scanned copy of the Power of Attorney in favor of the authorized person is to be attached), identification of the copyrighted work claimed to have been infringed, identification of the material on the site that is claimed to be infringing, the address, telephone number and e-mail address of the complaining party, a statement that the complaining party has confirmed with the copyright owner that use of the material in the manner complained of is not authorized by the copyright owner or the law, and a statement, under penalty of perjury, that the information in the notice of copyright infringement is accurate, and that the complaining party is authorized to act on behalf of the owner of the right that is allegedly infringed.
